The amount of rhetoric from the first day of the Chauvin trial is exhausting. I can only imagine the confusion of the 12 men and women sitting on the Chauvin jury.
The opening statements could not have been anymore different. I’m disappointed that there is an attempt to blame Mr. Floyd for his own death. I knew there would be an attempt to besmirch his character. The thing that people must remain cognizant of is that George Floyd is not on trial. He is the victim. Conversely Derek Chauvin is on trial.
There is a concept in the law called the “but for test”. Simply put the but for test posits a very simple question. But for the conscious behavior of Derek Chauvin would Mr. Floyd have survived the 9 PLUS MINUTES that Chauvin’s knee was on Floyds neck. But for the callous disregard the Derek Chauvin displayed over 9 PLUS MINUTES would George Floyd have been alive the next hour? Did Derek Chauvin exercise reasonable care in continuing to apply the weight of his body while George Floyd cried out that he couldn’t breathe and begged for his mother?
This is not a difficult case. The evidence is right there for all to say. The pathologist report regarding any pre-existing conditions that George Floyd may have had is irrelevant. What drugs may or may not have been in George Floyds system is irrelevant. The Law says that you take your victim as you find them.
George Floyd had no idea that he was going to be murdered that day. The notion of protecting and serving ticked away for over 9 minutes as Chauvin apply pressure to Mr. Floyds neck. This isn’t the first time that a black man as been summarily executed in the streets. It probably won’t be the last. What is different is that millions of Americans were glued to their television screens to watch the first day of this trial. Not since the trial of O J Simpson as a criminal trial garnered worldwide attention.
America the world is watching. Along with Derek Chauvin the American justice system is on trial. The jury is the entire world waiting and watching to see if justice exist in America. Is police accountability a real thing or have we allowed modern policing to morph into a Gestapo on steroids. THE WORLD IS WATCHING!
