They’re watching. The next group of insurrectionist is watching. They are waiting to see how serious the courts are in sentencing those who participated in the January 6th attempt at insurrection. The first sentence delivered yesterday does not bode well for sending the right message.

The court took the position that because the defendant had no past history that leniency was the best course of action. This is just dead wrong. It sends the wrong message and does nothing to act as a deterrent for the next time.

It looks weak because it is weak. For example in the law there is a concept called felony murder. A person commits the offense of felony murder when, in the commission of a felony, a the death of another human being occurs irrespective of malice. A person does not have to have intent or actively partisan in taking a life. They just have to be there and participate in the underlying act. The charge and the punishment are intentionally designed to act as a deterrent. Many a young person as found themselves ensnared by this law.

Why should the federal court show leniency to any person or persons who participated in the breach of the Capitol? Leniency does not take into consideration the serious nature of the offense. The judges handling these cases could very well be adding fuel to the fire 🔥 by showing Leniency insentencing based on past behavior. A murderer with a clean record is no less a murderer because they hasn’t done it in the past. What ever happened to last and order and the concept that no man is above the law?
