The Constitution has never been a perfect document. From the beginning the founders recognized the imperfection of the Constitution. The Constitution that Americans revere has codified many injustices such as the Dredd Scott Supreme Court decision and the Chinese imigration laws of 1882.

Brave courageous Presidents have been willing to test the boundaries of the Constitution to protect the interest of the people. When Lincoln realized that the preservation of the union required that the Confederate states be deprived of free slave labor he issued the emancipation proclamation. There was not section within the US Constitution giving him the authority but he did it anyway.

When Theodore Roosevelt was dealing with the coal strikes in 1902 three was no precedent for the government siezing private property but he did it anyway. Both of these men confronted huge holes in the Constitution to do what was intended best interest of the people. That’s what leadership looks like.

When Joe Biden says that there is nothing that he can do about the proliferation of mass shootings and the carnage that follows what he is really saying is that he lacks the courage to act in the peoples best interest. He can do a lot. He could define the perimeters of a well regulated militia so that non compliant groups calling themselves militia become illegal. He could declare a national emergency regarding gun violence to curtail the manufacture and sale of firearms. Those acts would require great bravery but they would protect the interest of the people. There would probably be court challenges regarding the Constitutionality of these acts. The Peoples interest would be protected and holes with our Constitution would be revealed and potentially dealt with. Desperate times require desperate measures.

  1. Biden is hollering bout what he can’t do! I wanna know what he can do! He needs not to ask permission, he needs to take leadership of America’s government! This damn stalemate the senate has going on ain’t working for none of america. The Unmitigated gall it took for the Senate to take they sorry butts home for a two week vacation in the mist of national tragedy. The whole debacle smells to high Heaven!

  2. Bill, I agree with you 100%. I was just going to post something on FB regarding the 2nd Amendment, and the misuse of its intent. The question is, “When will the American public rise up, and say “enough is enough?” Like most changes that take place in this country, it will have to come from a demand from the masses. The president and the legislature(in any administration) are short on initiating any real positive change. They most often must be motivated by public outcry. Once again, it’s up to the people to peacefully avenge the blood of their loved ones crying out from the grave. So that courage you reference, it appears, will only manifest itself in Biden like it did in LBJ when the people rise up and declare, as Peter Finch’s character did in the 1976 movie Network, “I’m mad as hell, and I’m not going to take it anymore.”
