Well the jury is out. I wish I could say that justice will be done but I know America with all her warts and blemishes. The defenses closing argument was a not so veiled plea to one racist juror on the panel. The question is can facts overcome racism. That is what this trial is all about.

In the prosecutions rebuttal it very clearly dealt with facts not supposition. All of the discussion about George Floyds drug use and lifestyle do not negate what I learned in my first year Criminal Law class. In tort law the eggshell skull maxim says that you take your victim as you find them. Maybe it’s time that the maxim be fully applied to criminal law. There is not one scintilla of proof that any of Mr. Floyds pre-existing conditions played a role in his death yet they were thrown out there like manure to fertilize the grass. Making the eggshell skull principal part of criminal law would end the discussion about proximate cause.

Derek Chauvin is guilty as hell. The obfuscation of the defense closing argument defies common sense but I’m reminded of what my father would so often say. “Common sense isn’t all that common”. While Chauvin is on trial for George Floyds murder the outcome of this trial will answer once and for all whether the United States can ever move beyond its ugly legacy. I’m not optimistic.

  2. Mr. Cobbs I agree with you the problem I have is why it wasn’t a even nbr of blacks with whites I am afraid that one bbn of the white is going to take stand of not guilty I feel that’s is a set up I sure hope I am wrong.
    Chauvin sit there with no remorse at all but rather a smirk on his face as saying I am going to get away with this like he’s sure he’s going to be acquitted. I hope they give a verdict today because to me it’s a clear guilty verdict
